Terms and Conditions

 It is essential to understand the terms and conditions that govern the use of our services to ensure a safe, enjoyable, and legally compliant experience for all our customers.  

These terms outline your rights and responsibilities as a customer, our obligations as a service provider, and relevant information regarding bookings, cancellations, liability, and vehicle use.

  1. For cancellation in less than 24 hours prior to the scheduled start time of the booked tour (per person/group), you may not be refunded or only receive a partial refund. Cancellation times are based on Western European Time (WEST).

  2. We are not responsible for any valuables left in the vehicle.

  3. All participants in Madeira Wild activities irrevocably assign all rights to the audiovisual material captured during the tour, allowing its unrestricted use for promotional purposes and disclosure without any expectation of compensation.

  4. Every person participating in our tours and activities must be at least 3 years old, and no older than 75 years old. Therefore It's your sole responsibility to verify such prerequisites before booking with us, otherwise you assume full responsibility for any repercussion that might happen during the tour or activity. Should you bring a minor, said responsibility equally extends to you. If we suspect you might be infringing this rule we might ask for age proof (e.g., ID card, passport) and further reserve the right to refuse participation if these requirements are not met.

  5. It is forbidden to eat or smoke inside the vehicle, if the need arises please refer to your driver;

  6. We may be forced to change, finish earlier than expected or outright cancel a particular tour due to unsafe weather conditions or other factors outside of our control, in which case refunds will be given in a case by case scenario;​

  7. Additional costs such as tickets, meals are not included, unless indicated in your chosen tour;

  8. Prices may change over time; therefore, even if a flyer or brochure states a different value, the final price will always be the one listed on the website or quoted via email. In the eventuality that the website lists one price and the email quotation states another, the quotation in the email will always supersede the one on the website.

  9. Your guide will caution you whenever they deem it necessary for safety and the proper conduct of the tour regarding hazards such as landslides and other dangers. Should you choose to ignore their instructions, we are not liable for any damages to your person or third parties.

  10. It's your sole responsibility of bringing all essentials such as appropriate clothing and footwear for the activity and weather conditions. as well any medicine you might need. Our cars are only equipped with a standard first aid kit and 2l fire extinguishers as per required by law.

  11. Clients are responsible for informing MadeiraWild of any pre-existing medical conditions or physical limitations that may affect their participation in the tours, ahead of the tour.

  12. Due to the nature of operations as well as not creating unwanted waste, we don't issue purchase receipts in paper, only through email, if you desire details such as your tax number within, please provide those details in advance.

  13. We are committed to minimizing our impact on the natural environment of Madeira.

  14. Littering is strictly prohibited. Clients and staff are responsible for disposing of waste properly.

  15. Disturbance of flora and fauna will be avoided. Clients are instructed not to feed or approach wild animals.

  16. We will respect any restrictions or guidelines set by local authorities regarding access to certain areas as well as adhere to all regulations and guidelines related to protected areas and natural parks.

  17. Safari routes will be planned to minimize environmental impact and avoid sensitive areas, where possible.

  18. Guides will be attentive to the needs of their clients and strive to provide a high-quality experience, in return is expected that the clients will respect and be courteous with our guides.

  19. A clear procedure for handling complaints will be in place to ensure that issues are addressed fairly and efficiently, likewise be used to improve our services.

  20. MadeiraWild will operate in full compliance with all relevant laws, regulations, and licensing requirements in Madeira and Portugal.

  21. This policy will be reviewed periodically and updated as necessary to reflect changes in regulations, best practices, or our business operations.

  22. All clients will be made aware of this policy and their booking will be considered as acceptance of these terms and conditions.

Privacy and Data Usage

At Madeira Wild Tours, we are committed to protecting your privacy. We only use your data to provide our services as intended, which includes processing your purchases, personalizing your experience, providing customer support etc.

To further secure your information, we implement reasonable security measures to protect your personal data from unauthorized access and misuse.

We believe in data minimization and therefore only store and use the minimum necessary information required for these services to function. For example, to process your orders, we collect your name, email address, method of payment amongst other mandatory as well as facultative data, such as, known allergies or other health impediments, preferences for certain types of tours, all information that helps us personalize your experience further. We further emphasise the importance of users' responsibility to provide accurate information and your commitment to keeping data accurate where possible, as we are not liable for any consequences should you not provide it correctly.

We strive to discard most of the information we collect appropriately within a reasonable time frame. For instance, financial data and order history is retained for 10 years for legal compliance with the Portuguese tax and accounting laws, or for no longer than necessary for the states purposes above, while non-essential data is anonymized after 3 months.

 

Third-Party Services: To provide our services effectively, we must sometimes share information with third-party service providers, such as payment processors. We carefully select reputable providers who have their own privacy policies. However, please understand that we cannot be held responsible for any misuse of your data by these third-party providers. We encourage you to review their privacy policies to understand their practices.

Your Rights: Depending on your location, you may have certain rights regarding your personal data (e.g., GDPR), such as the right to access, correct, or delete 1 your information. Please contact us at info@madeirawild.com if you wish to exercise these rights.

You have the right to lodge a complaint with the Portuguese supervisory authority, the Comissão Nacional de Protecção de Dados (CNPD).
